1. General informations
Apenta GmbH is the operator of the online marketplace swiss-made.shop, hereinafter referred to as Swiss Made Shop.
In the Swiss Made Shop, products can be offered and sold by various suppliers or sellers to customers domiciled in Switzerland, Liechtenstein or domiciled in the countries of the EU specified under shipping and delivery.
As a seller of goods, either Swiss Made Shop itself or retailer appear in the Swiss Made Shop.
2. Scope
The following T&Cs apply to all orders placed via our online shop. Our online shop is for consumers only.
3. Formation of contract
The display of products within the online shop constitutes a binding offer on our part to enter into a contract vis-à-vis the items. You may place our products in your basket without obligation and amend your entries at any time prior to submitting a binding order by using the correction facilities that are provided for this purpose and explained during the ordering process. The contract is formed by clicking on the order button which indicates your acceptance of our offer concerning the goods contained in your basket. Once you have sent your order you will immediately receive a confirmation via e-mail.
3.1 Sale of products by Swiss Made Shop
As far as on the respective product side no reference to another contractual partner than Swiss Made Shop contains, it concerns a product which is offered and sold directly by Swiss Made Shop.

3.2 Sales of products by retailers
If the respective product page contains a reference to a contractual partner other than Swiss Made Shop, it is a product of a retailer.
In this case these products are offered and sold by the respective dealer. The sales contract is concluded directly between the retailer (as seller) and the customer (as buyer).
Swiss Made Shop takes over the marketing of the corresponding products on behalf of the retailer and mediates the purchases. Swiss Made Shop always acts only as an intermediary and service provider for the retailer, but does not itself become a contractual partner of the customer.
4. Contract language, saving of the contract text
The language available for concluding the contract is German.
We save the text of the contract and forward the order data and our T&Cs to you by e-mail. The text of the contract cannot be accessed via the internet for security reasons.
5. Terms of use
To use Swiss Made Shop, customers can register as members at swiss-made.shop and open a customer account. Customers can also place orders on Swiss Made Shop without registration or membership, i.e. as guests. There is no right to registration or membership.
The offers on the Swiss Made Shop are basically aimed at customers over 18 years of age who are able to act. Customers under 18 years of age or persons who are not fully capable of acting confirm to Swiss Made Shop and the respective seller with every order that they have the consent of the legal representative for the corresponding purchase.
6. Delivery conditions
Delivery costs may be added to the product prices displayed. Further information on delivery costs, if applicable, are explained within individual product offers.
We only dispatch goods en route; pick up by the customer is not possible.
We do not deliver to packing stations.
The available shipping methods may vary for each seller. The information on the respective product page and the information on possible delivery methods at checkout, which are determined by the variety of products in the shopping basket, are decisive.
7. Payment
The following payment methods are basically available in our online shop:
Advance payment
If you select advance payment we provide you with our bank details in a separate e-mail and deliver the goods on receipt of funds.
Purchase by invoice with partial payment option (POWERPAY)
As an external payment provider, MF Group/POWERPAY offers the payment option ‘Pay by invoice’. You can simply pay for your online purchase by invoice using the order invoice. If you do not make the payment within the specified period, you will receive a subsequent monthly invoice the following month with an order overview.
When a purchase agreement is made, POWERPAY takes on the amount receivable and processes it using the payment method selected. By selecting purchase by invoice, you are also agreeing to our GTC, POWERPAY’s
Postfinance
With the PostFinance payment method, you can pay easily and conveniently to the debit of your postal account. After submitting the order, enter the card and ID number of the PostFinance Card or log in directly to e-finance.
Credit Card
With the submission of the order, you are sending us your credit card details at the same time.
After your identification as the legal cardholder, directly after the order, we will ask your credit card company to initiate the payment transaction. The payment transaction is automatically carried out by the credit card company and charged to your card.

Pay for your order conveniently with the TWINT app.
SOFORT Online Bank Transfer
After placement of the order, you will be forwarded to the online SOFORT GmbH website. In order to pay the invoice amount via SOFORT, you must have an online banking account with PIN/TAN process for participating in SOFORT, identify yourself accordingly and confirm the payment instructions to us. You will receive additional information during the order process. The payment transaction will be carried out by SOFORT and debited to your account directly thereafter.
PayPal
During the ordering process you will be forwarded to PayPal's online website. To pay the invoice amount via PayPal, you must be registered there or register first, identify yourself with your access data and confirm the payment instructions to us. After submitting your order in the shop we instruct PayPal to initiate the payment transaction.
Directly afterwards, the payment transaction is carried out automatically by PayPal. You will receive additional information during the ordering process.
8. Retention of title
The goods shall remain the property of the respective seller or of Swiss Made Shop (apenta GmbH) until full payment is made.
9. Damage during delivery
If the goods are delivered with obvious damage caused during delivery, please report the defect to the carrier and notify us without delay. Failure to make a complaint or to make contact does not in any way affect your legal rights or the enforcement of such rights, notably your warranty rights. However, in doing so you help us to assert our own claims against the carrier or transport insurer.
10. Warranty and guarantiees
We are under a legal duty to supply products that are in conformity with this contract.
For consumers, statutory warranty rights governed by the law of the country where the consumer has his habitual residence apply. Information on any additional guarantees and their precise conditions that may apply can be found next to the product and on specific information pages in the shop, if applicable.
11. Liability
We shall in any case be liable without limitation for claims due to damages that have been caused by us, our legal representatives or legal agents
- for injury to life, limb or health
- for deliberate or grossly negligent breach of duty
- for guarantee commitments, where agreed
- towards consumer.
Except these cases, our civil law liability is limited to the foreseeable and direct damages at the time of contract conclusion.
12. Online dispute resolution
The European Commission provides a platform for online dispute resolutions (ODR) which can be accessed at https://ec.europa.eu/consumers/odr/. In order to settle disputes arising from a contractual relationship with a consumer or from whether such a contractual relationship exists at all, we will participate in dispute settlement proceedings before a consumer dispute resolution body. 13. Protection of minors
Insofar as your order is comprised of goods, whose sale is subject to age restrictions, through the use of a reliable procedure, including a personal identity and age check, we shall ensure that the purchaser has reached the required minimum age. The deliverer shall only hand over the goods after an age check and only to the purchaser in person.
